| 内容記述 | Article 14 of the Maternal Protection Act requires the consent of the spouse for an abortion in addition to that of the woman herself（ This requirement is hereinafter referred to as the spousal consent requirement.）. The purpose of this paper is to summarize the interpretation and operation of the spousal consent requirement and to clarify some problems that this requirement poses. Although some aspects of the interpretation of the requirement have gradually become clearer as a result of questions from doctors, published administrative interpretations, and judicial decisions, there are still many unclear points, and it seems that many problems remain regarding the ambiguity and structure of Article 14 of the Maternal Protection Act and the spousal consent requirement itself. For example, the spousal consent is required in principle even when the continuation of pregnancy is extremely harmful to the woman’s health or when the woman becomes pregnant through non-consensual sexual intercourse, and if a doctor or woman performs an abortion without the spousal consent, they may face punishment. Also, the specific cases that fall under Article 14, Paragraph 2, which is an exception to the requirement, are not clear. Thus, this requirement unfairly restricts women’s reproductive health and rights. | |||||||||
