| 内容記述 | 本稿の目的は、法が特定のセックス概念への適応を強いるときに身体がいかに「法のまえ」に現れうるかを考察することである。 「法のまえ」という用語は、人格として等しく自由な成員からなる理念的領域を指す。 それは、制定法、判例、科学的文書などからなる法言説に還元できない領域であり、むしろ、そのような言説に先立つ領域である。 まず、イマジナリーな領域に関するコーネルの構想の検討から、自己の身体像を（再）想像／（再）創造する自由を物質的に実現するために、「法のまえ」に身を置きつつ、物質的世界に不平等で拘束的な秩序を付与する法言説に対峙する主体を措定しうることを確認する。 次に、バトラーによる社会運動論に対する批判的整理とこれとコーネルに関する先の議論との統合から、そのような主体は、還元不可能な差異をもつ諸身体として、現れうることを示す。 本研究の独自性は、法に抗う主体の理念的次元と身体的次元を焦点化する点にある。 |

| 内容記述 | This study explores how bodies stand “before the law” if and when a law forces them to conform to a given concept of sex. The term “before the law” denotes the conception of an ideal arena whose members are equally free as persons. The notion cannot be reduced to legal discourse comprising statutes, precedents, scientific documents, and such materials; rather, it represents a space that precedes that kind of discourse. First, this paper examines Cornell’s conception of the imaginary domain to confirm that we can posit those subjects who, so as to materialize their freedom to (re) imagine and (re) create their bodily image, both locate themselves “before the law” and confront all legal discourse that embeds discriminatory and binding order in the material world. Second, this paper critically integrates Butler’s theories on social movements with Cornell’s ideas to prove that such subjects can appear exactly as bodies whose differences are irreducible to each other. This study is original in its focal attention on the ideality and corporeality of subjects who criticize laws. |
